Client seeks assistance obtaining title of her childhood home. The home was owned by client’s mother, who passed away in 2016. Client signed a renunciation in 2017 nominating her brother as administrator of her mom’s estate. Without client’s knowledge, he drafted a deed that gave him sole title of the home. Client’s name is not on the new deed, she never signed over her interest in the property to her brother, and she never received any payment. Client moved into the home in 2020, and paid rent to her brother for five years. Her brother refuses to sign a corrective deed until client pays him for costs he claims he’s accrued related to the house, but client believes the rent she was paying for five years and the money that she has spent to repair the home is greater than those costs. A volunteer is needed to file an appropriate action to affirm client’s interest in the home.
