Client seeks title to her home to resolve a significant delinquent tax issue. The home is owned by a Delaware-based LLC created by client’s son, who died in 2018. Client’s son was convinced by a real estate agent to put the property into an LLC. Client cannot access the original LLC documents, but she has a Certificate of Formation listing the real estate agent as the registered agent. Client’s son died intestate, leaving client and client’s ex-husband as his heirs. Client received Letters of Administration for her son’s estate, and her ex-husband is cooperative with her receiving title. A volunteer is needed to investigate the LLC and determine the defendants. Then, file an appropriate action against to quiet the property in the estate of client’s son, and draft a deed transferring title to client.
